Court fines Cyprus over 'missing' dead soldier

NICOSIA, Cyprus (AP) ? Andriani Palma says she feels cheated for every one of the 22 years she wasn't told her husband was killed during fighting in the summer of 1974 that split tiny Cyprus along ethnic lines.

Living with the hope that Charalambos Palmas might one day return to her and her children, she lived in a kind of suspended animation, unwilling to remarry and move on with her life.

"They denied me my youth, the joys of being young, they denied me everything," Andriani, who is now 65, said. "There was prejudice in those times. I couldn't take the kids places, because they didn't have a father ...We've lived a mockery all those years."

But on Thursday a court offered her some sense of justice by ordering the Cypriot government to pay ?324,000 ($417,668) in damages to her and two daughters, Kalliopi and Christina, for denying them the right to know for two decades.

"After so much struggle, I feel vindicated," she says. "It's hardly the money, but the moral satisfaction."

Army authorities buried then 28-year-old reservist Palmas along with some 30 other Greek Cypriot soldiers in a mass grave marked "unknown" at Lakatamia cemetery on Nicosia's outskirts shortly after the fighting stopped. The soldiers were killed in heavy fighting as invading Turkish troops advanced in the northern Nicosia suburb of Ayios Pavlos.

Turkey invaded after a coup by supporters of union with Greece. The war split the island into a breakaway Turkish Cypriot north where Turkey maintains 35,000 troops, and an internationally recognized Greek Cypriot south.

In its ruling, the court said the state failed to carry out a timely probe into Palmas' fate, even if it had evidence indicating that he was dead.

The court said it awarded punitive damages on top of general damages to underscore how seriously the human rights of the soldier's family were breached.

"Sufficient evidence has been presented which demonstrates that the republic evaded its obligation to inform relatives in a proper and timely fashion and so violated their right to the truth, condemning the plaintiffs to such hardship that it bordered on inhumane treatment," the court said in its ruling. "The republic's behavior toward the plaintiffs from 1974 until now was, at the very least, insulting."

Palmas' lawyer Achilleas Demetriades said it's the first time that a Cypriot court has awarded punitive damages in a missing persons case.

Attorney General Petros Clerides said the state is "seriously considering" appealing the ruling.

Cypriot authorities only confirmed to Andriani Palmas her husband's death in 1996, two years after she started receiving bits of information about his real fate. It was three years later that his remains were returned and after Andriani in a fit of despair went to the cemetery to dig her husband up on her own.

Andriani's oldest daughter Kalliopi, who was only 5 in 1974 said a photograph of her mother, sister and their children standing next to her father's remains is the only family portrait that they have.

Kalliopi said the stigma of growing up without a father figured prominently in her childhood. But that was eclipsed by the bitter awareness of having grown up in the offices of the very same officials who kept the truth from her, even as her family took part in countless missing persons demonstrations clutching a photograph of her dad.

"What annoyed me was that my father wasn't just another faceless missing person, he had a name, he was somebody," she said.

About 1,500 Greek Cypriots and 500 Turkish Cypriots were officially listed as missing in intercommunal fighting in the early 1960s and the Turkish invasion.

An exhumation and identification program by the U.N.-led Committee on Missing Persons has returned the identified remains of 264 Greek Cypriots and 66 Turkish Cypriots to their families since it began in 2006.

After-school club ? Teacher Stephen Olson loves sharing his passion for board games.

Layton ? Growing up, Stephen Olson loved board games ? all kinds of board games.

He played them with his family and friends. When he went to college at the University of Utah, he started a board game club with fellow students.

Eventually Olson?s friends gave up board games for girlfriends, wives, children and other activities, and the club died out. But Olson?s love for games never diminished.

Fast forward to 2012, and Olson is a math teacher at North Layton Junior High. It?s his first year on the job, and he discovered there is no math club, so he volunteered to supervise one. He then discovers there is no chess club. It?s one of the few board games he doesn?t love, so he asked his administration if he could have a combination chess and board game club.

They consented.

On Tuesday and Thursday afternoons, the board game club meets after school from three to five. Olsen is a happy teacher?he gets the chance to play board games and share his knowledge and love of the game with students.

Olsen visited his parents? home and retrieved an assortment of his favorite games from youth including Ingenious, Small World and Tsuro. Other students play trading card games and still others play chess.

"I can?t resist playing games," Olson said. "I play while I?m correcting papers."

The games help students with reassigning skills and logic. Small World teaches them about combination and how things can synergize or work against one another. Olson said the students also have to learn to put on their poker faces when playing.

While the majority of game playing is friendly, tension can break out.

"Small World gets a little heated," Olson said.

Seventh-grader Alex Chipman loves the structure of board games.

"I have Asperger?s so this is one of the few times I can open up and enjoy myself," said Alex, who flits around the room checking out all the games. "I don?t like it when people don?t follow the rules. Here I don?t have to worry about people going against the rules because if they don?t follow them, the game won?t work."

Alex?s father, David Chipman, is a resource teacher at North Layton Junior High. He enjoys having Alex participate in the club. "It keeps him occupied and forces him to interact socially," he said. "I think it gives the kids a way of expressing their own personality without having to be afraid of what anybody else thinks about it because they all have a shared interest in the games. If you are passive or aggressive in your play it?s OK, it?s a game, and no one gets hurt."

Eighth-grader Miriam Wilson has always loved board games, and she has not missed a single day of club. At home she played Monopoly and Sorry. The club has introduced her to new games.

"I like playing with other people," Miriam said. "After I?ve played with them for a while, I know what they are thinking and what their next move is going to be."

At another table sit the trading-card gamers. Two brothers, Braden and Cameron Putnam, are in the club. They enjoy playing games with each other and their brother, but they joined the game club to play against new people.

Factory owner says unaware of need for fire exits

DHAKA, Bangladesh (AP) ? The owner of a Bangladesh clothing factory where a fire killed 112 people says he was never informed the facility was required to have an emergency exit, a sign of how far removed the leaders of the nation's garment industry are from issues of worker safety.

"It was my fault. But nobody told me that there was no emergency exit, which could be made accessible from outside," factory owner Delwar Hossain was quoted Thursday as telling The Daily Star newspaper. "Nobody even advised me to install one like that, apart from the existing ones."

"I could have done it. But nobody ever suggested that I do it," said Hossain, who could not be reached for comment by The Associated Press on Thursday.

Activists in the South Asian country hope the tragedy will invigorate their lengthy ? but fruitless ? efforts to upgrade safety standards and force stronger government oversight of the powerful industry.

The Tazreen Fashions Ltd. factory in a Dhaka suburb was making clothes for Wal-Mart, Sears, Disney and other major global retailers. When a fire broke out over the weekend, many of the 1,400 workers were trapped inside the eight-story building because exit doors were locked. A fire official said the death toll would have been much lower if the factory had had an emergency exit.

An AP reporter who visited the damaged factory Wednesday found three stairways but no special fire exits.

Hossain, a former accounts manager at another garment factory, set up his own clothing business, Tuba Textiles Mills Ltd. in 2004. The Tazreen factory was one of a dozen owned by his company.

Iqbal Habib, an architect and an activist, said fire exits were mandatory in such factories. He blamed government agencies, and the local industry trade group, for not ensuring the building was up to the proper standards.

"This is not acceptable. This is a serious issue. We must deal with such things seriously," he said.

Nazma Akhter, president of the Bangladesh Combined Garment Workers Federation trade union, called for the arrest of the factory's owners and management to send a message to the industry as a whole.

"There should be a criminal case against them. It could stop the recurrence of such incidents," he said.

Labor Minister Rajiuddin Ahmed Raju said that factories without emergency exits ? or with only one such exit ? will be forced to close until they upgrade their safety infrastructure. It was not clear when and how that directive will be enforced.

3 Renewable-Energy Nanotech Projects to Watch

According to three studies published in the journal?Technology and Innovation ? Proceedings of the National Academy of Inventors, nanotechnology research being conducted in Florida could improve energy efficiency in several different applications.

One such project, which is being developed by researchers at the Southeast National Marine Renewable Energy Center at Florida Atlantic University, will attempt to use the energy in ocean waves and current, Phys.org reported. Through research and development of materials and marine current turbines, great advances in harnessing the ocean's kinetic energy can be made, according to researchers.

Another project, which is being developed by engineers from the University of South Florida's Clean Energy Resource Center, attempted to use ?rectenna? devices to convert waste heat into electrical energy. These devices capture thermal radiation, which oftentimes is an overlooked source of renewable energy, according to Phys.org. Rectennas, which are a combination of an antenna and a tunnel diode, could be more efficient than solar power if the technology is made to be more efficient.

Physicists from the University of South Florida are looking at ways to use nanotechnology in greenhouses to improve energy efficiency. For use in hydroponic agriculture, a new lighting device -- called a nanophosphor-based electroluminesence lighting device --?could be used to create precise wavelengths of light required for indoor photosynthesis, eliminating wasted energy and saving growers money.

Simple measures cut infections caught in hospitals

(AP) ? Preventing surgery-linked infections is a major concern for hospitals and it turns out some simple measures can make a big difference.

A project at seven big hospitals reduced infections after colorectal surgeries by nearly one-third. It prevented an estimated 135 infections, saving almost $4 million, the Joint Commission hospital regulating group and the American College of Surgeons announced Wednesday. The two groups directed the 2 1/2-year project.

Solutions included having patients shower with special germ-fighting soap before surgery, and having surgery teams change gowns, gloves and instruments during operations to prevent spreading germs picked up during the procedures.

Some hospitals used special wound-protecting devices on surgery openings to keep intestine germs from reaching the skin.

The average rate of infections linked with colorectal operations at the seven hospitals dropped from about 16 percent of patients during a 10-month phase when hospitals started adopting changes to almost 11 percent once all the changes had been made.

Hospital stays for patients who got infections dropped from an average of 15 days to 13 days, which helped cut costs.

"The improvements translate into safer patient care," said Dr. Mark Chassin, president of the Joint Commission. "Now it's our job to spread these effective interventions to all hospitals."

Almost 2 million health care-related infections occur each year nationwide; more than 90,000 of these are fatal.

Besides wanting to keep patients healthy, hospitals have a monetary incentive to prevent these infections. Medicare cuts payments to hospitals that have lots of certain health care-related infections, and those cuts are expected to increase under the new health care law.

The project involved surgeries for cancer and other colorectal problems. Infections linked with colorectal surgery are particularly common because intestinal tract bacteria are so abundant.

To succeed at reducing infection rates requires hospitals to commit to changing habits, "to really look in the mirror and identify these things," said Dr. Clifford Ko of the American College of Surgeons.

The hospitals involved were Cedars-Sinai Medical Center in Los Angeles; Cleveland Clinic in Ohio; Mayo Clinic-Rochester Methodist Hospital in Rochester, Minn.; North Shore-Long Island Jewish Health System in Great Neck, NY; Northwestern Memorial Hospital in Chicago; OSF Saint Francis Medical Center in Peoria, Ill.; and Stanford Hospital & Clinics in Palo Alto, Calif.

Bernanke: Federal Reserve's Tools Can't Offset Fiscal Tightening ...

With the fiscal cliff (automatic tax hikes and spending cuts) arriving on January 1, 2013, Federal Reserve Chairman Ben Bernanke, in a speech given at the Economic Club of New York on November 20, 2012 (1:12 in the video), wanted to remind everyone that monetary policy can't offset fiscal tightening. He said, "I don't think the Fed has the tools to offset that. And that's why it is important for Congress to address these fiscal issues soon and in a bipartisan way."

"Upcoming Fiscal Challenges
What are these looming challenges? First, the Congress and the Administration will need to protect the economy from the full brunt of the severe fiscal tightening at the beginning of next year that is built into current law--the so-called fiscal cliff. The realization of all of the automatic tax increases and spending cuts that make up the fiscal cliff, absent offsetting changes, would pose a substantial threat to the recovery--indeed, by the reckoning of the Congressional Budget Office (CBO) and that of many outside observers, a fiscal shock of that size would send the economy toppling back into recession. Second, early in the new year it will be necessary to approve an increase in the federal debt limit to avoid any possibility of a catastrophic default on the nation's Treasury securities and other obligations. As you will recall, the threat of default in the summer of 2011 fueled economic uncertainty and badly damaged confidence, even though an agreement ultimately was reached. A failure to reach a timely agreement this time around could impose even heavier economic and financial costs.

As fiscal policymakers face these critical decisions, they should keep two objectives in mind. First, as I think is widely appreciated by now, the federal budget is on an unsustainable path. The budget deficit, which peaked at about 10 percent of GDP in 2009 and now stands at about 7 percent of GDP, is expected to narrow further in the coming years as the economy continues to recover. However, the CBO projects that, under a plausible set of policy assumptions, the budget deficit would still be greater than 4 percent of GDP in 2018, assuming the economy has returned to its potential by then. Moreover, under the CBO projection, the deficit and the ratio of federal debt to GDP would subsequently return to an upward trend.9 Of course, we should all understand that long-term projections of ever-increasing deficits will never actually come to pass, because the willingness of lenders to continue to fund the government can only be sustained by responsible fiscal plans and actions. A credible framework to set federal fiscal policy on a stable path--for example, one on which the ratio of federal debt to GDP eventually stabilizes or declines--is thus urgently needed to ensure longer-term economic growth and stability.

Even as fiscal policymakers address the urgent issue of longer-run fiscal sustainability, they should not ignore a second key objective: to avoid unnecessarily adding to the headwinds that are already holding back the economic recovery. Fortunately, the two objectives are fully compatible and mutually reinforcing. Preventing a sudden and severe contraction in fiscal policy early next year will support the transition of the economy back to full employment; a stronger economy will in turn reduce the deficit and contribute to achieving long-term fiscal sustainability. At the same time, a credible plan to put the federal budget on a path that will be sustainable in the long run could help keep longer-term interest rates low and boost household and business confidence, thereby supporting economic growth today.

Coming together to find fiscal solutions will not be easy, but the stakes are high. Uncertainty about how the fiscal cliff, the raising of the debt limit, and the longer-term budget situation will be addressed appears already to be affecting private spending and investment decisions and may be contributing to an increased sense of caution in financial markets, with adverse effects on the economy. Continuing to push off difficult policy choices will only prolong and intensify these uncertainties. Moreover, while the details of whatever agreement is reached to resolve the fiscal cliff are important, the economic confidence of both market participants and the general public likely will also be influenced by the extent to which our political system proves able to deliver a reasonable solution with a minimum of uncertainty and delay. Finding long-term solutions that can win sufficient political support to be enacted may take some time, but meaningful progress toward this end can be achieved now if policymakers are willing to think creatively and work together constructively.

Monetary Policy
Let me now turn briefly to monetary policy.

Monetary policy can do little to reverse the effects that the financial crisis may have had on the economy's productive potential. However, it has been able to provide an important offset to the headwinds that have slowed the cyclical recovery. As you know, the Federal Reserve took strong easing measures during the financial crisis and recession, cutting its target for the federal funds rate--the traditional tool of monetary policy--to nearly zero by the end of 2008. Since that time, we have provided additional accommodation through two nontraditional policy tools aimed at putting downward pressure on longer-term interest rates: asset purchases that reduce the supply of longer-term securities outstanding in the market, and communication about the future path of monetary policy.

Most recently, after the September FOMC meeting, we announced that the Federal Reserve would purchase additional agency mortgage-backed securities (MBS) and continue with the program to extend the maturity of our Treasury holdings.10 These additional asset purchases should put downward pressure on longer-term interest rates and make broader financial conditions more accommodative.11 Moreover, our purchases of MBS, by bringing down mortgage rates, provide support directly to housing and thereby help mitigate some of the headwinds facing that sector. In announcing this decision, we also indicated that we would continue purchasing MBS, undertake additional purchases of longer-term securities, and employ our other policy tools until we judge that the outlook for the labor market has improved substantially in a context of price stability.

Although it is still too early to assess the full effects of our most recent policy actions, yields on corporate bonds and agency MBS have fallen significantly, on balance, since the FOMC's announcement. More generally, research suggests that our previous asset purchases have eased overall financial conditions and provided meaningful support to the economic recovery in recent years.12

In addition to announcing new purchases of MBS, at our September meeting we extended our guidance for how long we expect that exceptionally low levels for the federal funds rate will likely be warranted at least through the middle of 2015. By pushing the expected period of low rates further into the future, we are not saying that we expect the economy to remain weak until mid-2015; rather, we expect--as we indicated in our September statement--that a highly accommodative stance of monetary policy will remain appropriate for a considerable time after the economic recovery strengthens.13 In other words, we will want to be sure that the recovery is established before we begin to normalize policy. We hope that such assurances will reduce uncertainty and increase confidence among households and businesses, thereby providing additional support for economic growth and job creation.

Conclusion
In sum, the U.S. economy continues to be hampered by the lingering effects of the financial crisis on its productive potential and by a number of headwinds that have hindered the normal cyclical adjustment of the economy. The Federal Reserve is doing its part by providing accommodative monetary policy to promote a stronger economic recovery in a context of price stability. As I have said before, however, while monetary policy can help support the economic recovery, it is by no means a panacea for our economic ills. Currently, uncertainties about the situation in Europe and especially about the prospects for federal fiscal policy seem to be weighing on the spending decisions of households and businesses as well as on financial conditions. Such uncertainties will only be increased by discord and delay. In contrast, cooperation and creativity to deliver fiscal clarity--in particular, a plan for resolving the nation's longer-term budgetary issues without harming the recovery--could help make the new year a very good one for the American economy."


Chairman Bernanke also warned about the fiscal cliff at his FOMC press conference on September 13, 2012 (full transcript).
"MICHELLE FLEURY. You said that you can?t cure all ills, that you haven?t got strong enough tools to deal with the unemployment problem. I was curious to know what policy actions you?d like to see outside the Fed to try and address this. And, secondly, also on the ?fiscal cliff,? the expected spending cuts and tax increases, how concerned are you about that? And what ammunition do you have to deal with that, if that becomes a problem?

CHAIRMAN BERNANKE. Well there?s, again, a range of areas where actions could be taken, and I can?t really prescribe all those possible responses. I would focus, I think, on the fiscal side. We currently have the so-called fiscal cliff. If no action is taken, there?s going to be?a very substantial increase in taxes and cut in spending on January 1 of the coming year. The CBO has suggested that if that?s allowed to take place, that it would cause unemployment to begin to rise, and it might throw the economy back into recession. So I think one very basic?thing that could be done to help address the recovery?the weakness of the recovery and the need for more employment?would be to address the fiscal cliff while simultaneously addressing longer-term fiscal sustainability issues which remain, of course, very serious. So that?s one area?where there is a lot of potential benefit. If the fiscal cliff isn?t addressed, as I?ve said, I don?t think our tools are strong enough to offset the effects of a major fiscal shock, so we?d have to think about what to do in that contingency. So I think it?s really important for the fiscal policymakers to, you know, work together and try to find a solution for that."


But, just in case the Fed gets desperate, the FOMC Minutes of the October 23-24 meeting mentioned that QE4 "would likely be appropriate" when the "maturity extension program" (aka Operation Twist) ends at the end of the year.
"Participants also discussed the efficacy and potential costs of the Committee's asset purchases. A number of participants offered the assessment that the Committee's policy actions, to date, had been effective in making financial conditions more accommodative and that lower interest rates were providing support to aggregate spending, most notably in areas such as housing, autos, and other consumer durables. In particular, some pointed out that the favorable developments in mortgage markets over the intermeeting period suggested that the MBS purchases were likely to reinforce the nascent recovery in the housing market. Several added that, based on the experience with earlier asset purchases, the broader effects on economic activity from more-accommodative financial conditions were likely to accrue over time. Looking ahead, a number of participants indicated that additional asset purchases would likely be appropriate next year after the conclusion of the maturity extension program in order to achieve a substantial improvement in the labor market. In that regard, a couple of participants noted the likely usefulness of clarifying the range of indicators that would be evaluated in assessing the outlook for the labor market. Participants generally agreed that in determining the appropriate size, pace, and composition of further purchases, they would need to carefully assess the efficacy of asset purchases in fostering stronger economic activity and consider the potential risks and costs of such purchases. Several participants questioned the effectiveness of the current purchases or whether a continuation of them would be warranted if the recent moderate pace of economic recovery were sustained."

At the moment, some investors (probably those in the highest tax bracket, see Obama's tax plan) are realizing profits before the Bush tax cuts expire. We'll see what kind of deal the Republicans and Democrats make on taxes and spending (if any). And the next debt ceiling debacle should be fun as well.

Tulsa Foreclosures Down 35% From Last Year | Tulsa Real Estate ...

While there was a slight uptick in foreclosures this October, Tulsa home foreclosures are down 35% from last year. The first 10 months of 2012 saw far fewer home?repossessions?as compared to the same time in 2011. RealtyTrac Inc., a real estate data service, says that 577 foreclosures were filed in October,?up 6.5% from September. But overall, 2012 has seen 35.6% fewer foreclosures during the first 10 months.

Margo Mitchell, CEO of Consumer Credit Counseling Centers of Oklahoma, notes,??From our side, we haven?t seen as many people seeking foreclosure prevention counseling. I?m hoping that?s a sign the housing market is beginning to right itself after all these years.? It?s encouraging news because the downturn in foreclosures means fewer people are in danger of losing their Tulsa homes.

According to Mitchell, those who are seeking credit counseling are still having a hard time getting their banks to help them out with mortgages. She says it sometimes take months for banks to get loan modifications resolved. Even still, foreclosures across Oklahoma have declined 43.9% from last year, resulting in a rate of one for every 1,440 households.

Daren Blomquist, vice president of Irvine, Calif.-based RealtyTrac, said that foreclosure trends continue to vary widely from state to state. He adds,??Unfortunately, the three states dealing with the biggest rebound in deferred foreclosure activity ? New Jersey, New York and Connecticut ? also had to deal with the devastation to homes inflicted by superstorm Sandy. The foreclosure moratoriums being put into effect as a result of the storm will likely extend the already-lengthy time to foreclose in these states, further prolonging a fundamentally sound housing recovery.?

Internet boosts S.Africa's Naspers H1 profit

JOHANNESBURG (Reuters) - South African e-commerce and media firm Naspers posted an expected 15 percent rise in first-half earnings on Tuesday boosted by its Internet businesses.

The Cape Town-based company with operations in emerging economies including Russia, China and Brazil said core headline earnings came in at 1,062 cents per share in the six months to end-September, from 921 cents a year earlier.

It had flagged this month that underlying profit would rise by between 10 to 20 percent. Core headline profit, which Naspers says is its main earnings measure, excludes one-time items.

One-time items included a 1.5 billion rand profit from the sale of some Facebook shares by Russian affiliate Mail.ru. Naspers owns 29 percent in Mail.ru.

Total revenue climbed 22 percent to 23 billion rand after Internet revenue rose 70 percent to 14.1 billion rand.

Naspers said it spent $530 million investing in new e-commerce businesses including Netretail, an on-line retailer with operations in Eastern Europe.

Naspers started off as a newspaper publisher in apartheid South Africa and has morphed into a global multimedia business acquiring stakes in emerging-market Internet companies such as China's Tencent and Brazil's Buscape.

Naspers' shares have risen over 50 percent this year. At 70 times price earnings, the company is considered expensive compared with the average of 13.5 times for Johannesburg's Top-40 index of blue chips.

DHAKA, Bangladesh (AP) ? At least 112 people were killed in a fire that raced through a multi-story garment factory just outside of Bangladesh's capital, an official said Sunday.

The blaze broke out at the seven-story factory operated by Tazreen Fashions late Saturday. By Sunday morning, firefighters had recovered 100 bodies, fire department Operations Director Maj. Mohammad Mahbub told The Associated Press.

He said another 12 people who had suffered injuries after jumping from the building to escape the fire later died at hospitals.

The death toll could rise as the search for victims was continuing, he said.

The cause of the fire was not immediately known.

Bangladesh has some 4,000 garment factories, many without proper safety measures. The country annually earns about $20 billion from exports of garment products, mainly to the United States and Europe.

Mahbub said firefighters recovered 69 bodies from the second floor of the factory alone. He said most of the victims had been trapped inside the factory, located just outside of Dhaka, with no emergency exits leading outside the building.

Many workers who had taken shelter on the roof of the factory were rescued, but firefighters were unable to save those who were trapped inside, Mahbub said.

He said the fire broke out on the ground floor, which is used as a warehouse, and spread quickly to the upper floors.

"The factory had three staircases, and all of them were down through the ground floor," Mahbub said. "So the workers could not come out when the fire engulfed the building."

"Had there been at least one emergency exit through outside the factory, the casualties would have been much lower," he said.

Army soldiers and paramilitary border guards were deployed to help police keep the situation under control as thousands of onlookers and anxious relatives of the factory workers gathered at the scene, Mahbub said.

He would not say how many people were still missing.

Prime Minister Sheikh Hasina expressed her shock at the loss of a huge number of lives in the blaze and asked authorities to properly conduct rescue operations.

The Bangladesh Garment Manufacturers and Exporters Association, the apex body of the garment sector, said the association would stand by the victims' families.

Bangladesh's garment factories make clothes for brands including Wal-Mart, JC Penney, H&M, Marks & Spencer, Carrefour and Tesco.

Alexandra 'Sasha' McHale Dead: Kevin McHale's Daughter Dies At 22

HOUSTON ? The daughter of Houston Rockets coach Kevin McHale has died at 23.

Alexandra "Sasha" McHale died Saturday, and the team disclosed no other details Sunday.

Kevin McHale has been on leave since Nov. 10 to deal with what the team called a personal family matter. During his absence, Kelvin Sampson has been the interim coach. There is no timetable for Kevin McHale's return.

Team owner Leslie Alexander said in a statement that he extends his "deepest condolences" over the loss of the McHales' "beautiful daughter." He called Kevin and wife Lynn "loving and dedicated parents who will need our continued support throughout this very difficult time." He said the "entire organization is mourning."

Some of the Rockets expressed their support for McHale.

James Harden tweeted: "Praying for coach McHale and his family." Chandler Parsons added on Twitter: "R.I.P. Sasha."

McHale spent several years with the Minnesota Timberwolves as a coach and executive before joining the Rockets following two seasons as a television analyst.

"While Kevin was with our organization, we all watched Sasha grow up and become an outstanding young woman," Timberwolves owner Glen Taylor said in a statement. "She will be sorely missed by her family and friends."

NC Governor Pat McCrory: Family Law Reform For Shared Parenting

NC Governor Pat McCroryFathers and Families is asking NC Governor Pat McCrory to start talking with NC Senate and House leaders about bringing the presumption for Equally Shared Parenting to NC Children so that they can experience direct support, love, guidance, and nurturing from both parents and extended families. As a reader of this article, be it a non-custodial parent, step-parent, grandparent, or other interested party, it is important to widely share this article with other NC non-custodial family members on sites like Facebook, Twitter, Linkedin, and other networks to help rally them around this issue. Governor Pat McCrory needs to hear from NC non-custodial families numbering in the millions that they are tired of being marginalized in their childrens lives as visitors 5 days a month. NC Governor Pat McCrory needs to understand that having two equal parents at the table for children that are providing emotional, physical, psychological, and direct financial support to them brings far greater resources and opportunities than any big government enforcement agency like child support enforcement can ever deliver. Fathers and Families strongly believes that in situations where custodial parents who are receiving expanding social services like educational assistance, housing assistance, food assistance, medical assistance, job assistance, and other programs which is creating havoc on the NC budget, that there will be less of a need for these programs when you have the non-custodial parent and extended family in the lives of children. NC Governor Pat McCrory needs to understand that currently in the NC Family Law system, non-custodial parents and families are pushed to the margins of kids lives and can only offer financial help to their children.

Governor Pat McCrory and the NC Family Law System

  • Governor McCrory must understand that the current family law courts are about one parent winning, and the other parent losing. This system sets the stage for further despair, animosity, anger, and anxiety for the non-custodial parent and extended family after a divorce. Father and Families believes that no one parent should win in the court system, and that courts should reward two parents for working together for the betterment of the children.
  • Governor Pat McCrory and the NC Legislature must understand that the current Family Law system puts NC children at an economic disadvantage for decades. Currently, the average child custody battle costs EACH parent about $20,000 and statistics show that these parents will fight two in eighteen years. Additionally, parents will find minor contempt battles, child support enforcement battles, custody modification battles, and other battles costing more money. Fathers and Families believes that NC Parents spend at a minimum of $100,000 over the life of the minor child. Fathers and Families would like to see this money go towards a child?s education, healthcare, a home, or to start a business.
  • Governor Pat McCrory and The NC House and Senate needs to understand that the current NC Family Law System pits two parents against each other in an attempt to win a court battle. NC Parents are using every means available to win and this has dramatic negative effects on children. Through Shared Parenting, there is nothing to win because both parents will be equalized. When NC Judges change the current stage from ?OK, You guys fight it out and whoever has the most dirt loses? to that of ?You both are going to present a shared parenting plan for the benefit of the child and whoever does not abide by it loses? then you will see less conflict between parents.
  • Consistently, more and more studies show that children who have significant access to fathers (the usual non-custodial parent) do better in school, have less emotional problems, are able to resist drugs, and avoid pregnancy until later in life.
  • Governor Pat McCrory must understand that we believe hundreds of thousands of NC non-custodial parents do not have the money for an attorney to seize visitation rights to their children, or advocate for them in the courts. There should be no pay wall for a parent to see his/her children.
  • Governor Pat McCrory and NC Representatives and Senators must understand that 40% of children born today in NC come from non-married parents, and under current law, the biological father has zero rights and access to the child unless he can find $5000-7000 and hire an attorney to legitimate the children. This is assuming if he is ever aware that he has a child.
  • Governor Pat McCrory and the NC Legislature needs to understand that NC non-custodial families are going bankrupt hiring private attorneys at $5000 per incident when custodial parents get free government lawyers each time child support wants to be modified by the custodial parent.
  • Governor McCrory and NC Representatives should be aware that whenever a custodial parent gets into trouble financially, social service is able to save them using housing assistance, job assistance, food assistance, medical assistance, psychological assistance, other assistance programs and tax incentives. When non-custodial parents get into trouble financially, they go to jail. Governor, would it not make more sense to strengthen BOTH parents for the good of NC children?
  • Fathers and Families is sending the message to NC Governor Pat McCrory that it is time to stop ALL NC adoptions until amended legislation is in place protecting a biological father from having a child he did not know existed from being adopted out. Consistently, we are hearing more and more fathers tell us that they learned about a biological child of theirs being adopted out because the mother of the child refused to help adoptions agencies discover the father. Fathers and Families is not against adoptions, but we do believe that a biological parent?s natural love outweighs an adoptive family?s love. This issue not only affects NC Fathers, but the many women in paternal families who have a natural love for their biologically related children.

Fathers and Families believes there are many positive outcomes for NC children in families with shared parenting, and we are asking Governor Pat McCrory to review this information when considering legislation surrounding it.

  • First and foremost, despite the breakup of a marriage, NC Children still have a family. Equally Shared Parenting is the next best thing to preserving that feeling of knowing that you have a mother, father, grandparents, and aunts and uncles that are consistently in your life. Under current NC Law and in the family law courts, non-custodial parents and extended families are pushed far into the margins of a child?s life.
  • A NC Equally Shared Parenting initiative means less drain on Welfare and Low Income Assistance programs. When NC non-custodial parents, step-parents, and other family members are brought into equality with the custodial parent and have considerably more time to directly support children, there will be 50% more resources and opportunities to meet kids needs, thus decreasing the need for public assistance.
  • Governor Pat McCrory should know NC Family Law reform and equally shared parenting creates more free time for custodial mothers to further a college education (or add to formal education), learn a trade, start a business, or pursue social endeavors.
  • Equally Shared Parenting will allow fathers the opportunity to put into action fatherhood initiatives have taught them. Why have a fatherhood initiative if you are never going to allow these parents to put what they learned into action?
  • Mandating shared physical custody or equally shared parenting will lead to a reduction in bitter, destructive child custody battles, which put intense emotional strain on children following a divorce or separation. Fathers and Families believes that Governor Pat McCrory surely understands the importance of this.
  • NC Shared Parenting will decrease domestic violence. Many times prior, during, and after a divorce, one parent will fear losing touch with their kids because it is widely known in NC that there is a system that mandates that one parent has the majority of time with the children, and the other parent does not. In NC, 85% of parents are fathers in a State that has no presumption for which parent gets custody. Additionally, Family Law Judges consistently allow a custodial parent to move a child hundreds of miles away from a non-custodial family. This fear, anxiety, despair, and emotional struggle unfortunately leads to domestic violence.

Statement on Social Security Title IV-D Legislation

Fathers and Families wants Governor Pat McCrory to understand that the Social Security Act, Title IV, Part D, and specifically section 458 which is entitled ?Incentive Payments To States? is a revenue stream for NC Social Services Jobs, Programs, and Services. In NC, for each dollar collected in Child Support, the State gets back a match amount of federal money that is then used to replenish Welfare money. While at face value this may seem positive, it actually isn?t because the State of NC has become dependent on this money and NEEDS non-custodial parents as far from their children as possible so that they pay greater child support money and trigger greater federal money. Fathers and Families has faith in Governor McCrory, the NC Senate, House of Representatives, and Family Law Judges to find an alternative way to fund Social Services outside of separating kids from half of their family.

Opposition Governor Pat McCrory Is Likely To Receive From Those Opposed To Shared Parenting and NC Family Law Reform

  • American Bar Association/NC State Bar: If Governor Pat McCrory decides to encourage the NC Senate and House to consider Shared Parenting in NC, he is going to meet serious resistance from Lawyers and Judges. While they will have a myriad of cherry picked reasons why shared parenting is dangerous for children, the fact is under shared parenting, without parents fighting for 18 years NC lawyers are not receiving their enormous retainer fees and hourly fees that are charged in Family Law cases. NC Judges will resist Family Law reform and shared parenting because it will take away their discretion in what they say is needed because every case is different. Unfortunately, with 100% discretion comes the ability to abuse the system and legislate from the bench or allow biases to come into play without an accountability.
  • Governor Pat McCrory will undoubtedly meet resistance from ?Womens Rights Groups? like the National Organization For Women? who also will bring cherry picked statistics and reasons why Family Law Reform and Shared Parenting is a bad idea for Women and Children. The immediate problem we see for these organizations is that for decades they were about advancement for equality, but in Family Law they are asking for inequality. To Fathers and Families this smells of disingenuous agendas and politics at play. Furthermore, and this is important, there are a LOT of women who are hurt in a divisive Family Law system. These women include step-mothers, paternal grandmothers, aunts, female step-children, now adult female children, and even custodial mothers with male children who will find themselves marginalized later in life if we do not have Family Law reform in NC.
  • Domestic Violence Groups in NC will also oppose any type of Family Law Reform and Shared Parenting because they feel that Shared Parenting means that Fathers will have greater access and chances to kill and hurt children and former spouses. In addition, these groups will have their own set of cherry picked statements and professionals in the radical Womens groups with what seems like compelling data. However, Fathers and Families asks Governor Pat McCrory to use some common sense around domestic violence. First, custodial mothers and women hit, intimidate, and use control every day and nobody in these groups are talking about them crossing some hurdle to be with their kids. And, if you believe THEIR statistics that more domestic violence is committed from men, does it really matter WHO is doing it the most? The problem is Domestic Violence, not which gender is doing it the most. And, in reality, does Governor McCrory really believe that the best way to de-escalate a father from committing domestic violence is to completely alienate him from his children, see them moved hundreds of miles away, and watch as the women in his family get hurt? Fathers and Families is appealing to Governor Pat McCrory not to give into the gender warfare and politics surrounding Domestic Violence by those who want to make it a political football for their agendas.

Statement on False Allegations of Domestic Violence and Child Abuse

Fathers and Families hears daily from many non-custodial families, be it fathers, mothers, and men and women in the extended family who tell us that the majority of child custody battles and child support enforcement cases today involve some type of false allegation of Domestic Violence or Abuse in the hopes of gaining a tactical advantage in the NC Family Courts. Given the emotion surrounding these issues, many NC Judges are allowing these false allegations to proceed to conviction to ?be on the safe side.? The problems with this is, that a simple allegation in NC can lead to complete alienation of children from their fathers, step-mothers, grandmothers, aunts and uncles, and step-siblings.

Governor Pat McCrory and NC Non-Custodial Family Voters

Undoubtedly Governor Pat McCrory is aware of the divorce statistics in NC, and rate at which parents are having children outside of marriage. With that, Fathers and Families believes that roughly HALF of the NC population has either a direct tie or indirect tie to a NC non-custodial family member who sees the struggle they endure within the NC Family Law system and courts. Furthermore, Governor McCrory needs to understand that non-custodial families come from all racial and ethnic backgrounds, political party affiliations, and socioeconomic backgrounds. And, one can clearly see that many WOMEN in non-custodial families are equally hurt in the NC Family Courts unless we bring about reform for the presumption for Equally Shared Parenting.

HOW THE UNDERSTANDING "ACTS UPON" THE MATERIAL OF SENSIBLE EXPERIENCE

Bowman, C., 2001, maintained that it was not fundamental principles, but pure, that sensible intuition that are space and time, was the first datum that made a priori knowledge possible, though only of objects of the senses; according to Kant, synthetical principles could not be derived from mere concepts without intuition; on the contrary, they could only exist with reference to this intuition, and therefore to objects of possible experience, since it is the concepts of the understanding, united with this intuition, which alone make that knowledge possible which we call experience. Beyond objects of experience, and therefore with regard to things as noumena, all positive knowledge was rightly disclaimed for speculative reason; this reason, however, went so far as to establish with certainty the concept of noumena.

Bowman, C., 2001, insisted that the moral law, gives us a fact absolutely inexplicable from any data of the sensible world, and the whole compass of our theoretical use of reason, a fact which points to a pure world of the understanding and enables us to know a law.?? This law gives to the world of sense, which is a sensible system of nature, the form of a world of the understanding, that is, of a supersensible system of nature. A system of nature is the existence of things under laws.? The sensible nature of rational beings in general is their existence under laws empirically conditioned.? The supersensible nature of the same beings is their existence according to laws which are independent of every empirical condition and belong to the autonomy of pure reason. And,? since the laws by which the existence of things depends on cognition are practical, supersensible nature, so far as we can form any notion of it, is nothing else than a system of nature under the autonomy of pure practical reason. Now,? the law of this autonomy is the moral law, which, therefore, is the fundamental law of a supersensible nature, and of a pure world of understanding. For the moral law, in fact, transfers us ideally into a system in which pure reason would produce the summum bonum, and it determines our will to give the sensible world the form of a system of rational beings.

Bowman, C., 2001, propounded that reason must cognize causality with respect to the actions of the will in the sensible world in a definite manner; otherwise, practical reason could not really produce any action.? But as to the notion which it forms of its own causality as noumenon, it need not determine it theoretically with a view to the cognition of its supersensible existence, so as to give it significance in this way.? For it acquires significance apart from this, though only for practical use, namely, through the moral law.? Theoretically viewed, it remains always a pure a priori concept of the understanding, which can be applied to objects whether they have been given sensibly or not, although in the latter case it has no definite theoretical significance or application, but is only a formal, though essential, conception of the understanding relating to an object in general.? The significance which reason gives it through the moral law is merely practical, inasmuch as the idea of the idea of the law of causality has self causality, or is its determining principle. Bowman specified that our entire cognitive faculty is, therefore, presented with an unbounded, but, also, inaccessible field-the field of the supersensible-in which we seek in vain for a territory, and on which, therefore, we can have no realm for theoretical cognition, be it for concepts of understanding or of reason.? This field we must indeed occupy with ideas in the interest as well of the theoretical as the practical employment of reason, but, in connection with the laws arising from the concept of freedom, we cannot procure for these ideas any but practical reality, which, accordingly, fails to advance our theoretical cognition one step towards the supersensible.

While, Makkreel, R.A., 2003, persisted that all of the general epistemic claims of the Aesthetic and the Analytic concern cognition. Space and time as the forms of intuition and the categories of the understanding are claimed to make our cognition of the objects of nature possible.? They are the a priori conditions that we bring to experience on the basis of our cognitive faculties and they explicate what it means to be an object of our experience.? The categories are not merely logical concepts that can relate representations to each other within consciousness. They are transcendental concepts because they relate a subject's representations to some object that can appear to it. Transcendental concepts are concepts that anticipate the possible meaning that the phenomenal objects of nature can have.? Kant said that the schemata of the concepts of pure understanding are the true and sole conditions for providing them with a relation to objects, thus with meaning; they merely serve to subject appearances to general rules of synthesis and thereby to make them fit for a thoroughgoing connection in one experience.? Kant claimed that what the categories legislate to the phenomena of our experience is merely formal and relational; causal relations as Kant conceives them are purely external, and phenomenal objects can only be determined from without, therefore we cannot understand the inner nature of things.

Kant, I., 1790, insisted that for the faculty of cognition understanding alone is legislative, if this faculty is referred to nature, in respect of which alone as phenomenon it is possible for us to prescribe laws by means of a priori concepts of nature, which are properly pure concepts of understanding. Kant? claimed that as universal laws of nature have their ground in our understanding, which prescribes them to nature, particular empirical laws must be regarded, in respect of that which is left undetermined in them by these universal laws, according to a unity such as they would have if an understanding had supplied them for the benefit of our cognitive faculties, so as to render possible a system of experience according to particular natural laws. Kant marked that the principle of judgement, is the finality of nature in its multiplicity and by this concept, nature is represented as if an understanding contained the ground of the unity of the manifold of its empirical laws.

Kant, I., 1781, defined understanding as the faculty of thinking the object of sensuous intuition. Without the sensuous faculty no object would be given to us, and without the understanding no object would be thought; understanding cannot intuite, and the sensuous faculty cannot think in no other way than from the united operation of both, can knowledge arise. Kant? specified that the science of the laws of sensibility is aesthetic, and the science of the laws of the understanding, is logic; the first contains the absolutely necessary laws of thought, without which no use whatsoever of the understanding is possible, and gives laws therefore to the understanding, without regard to the difference of objects on which it may be employed. Kant? further stated that the logic of the particular use of the understanding contains the laws of correct thinking upon a particular class of objects; aesthetic may be called elemental logic and the logic is an organon of this or that particular science. According to Kant,? general logic is either pure or applied; and in aesthetic we abstract all the empirical conditions under which the understanding is exercised; the cognition of every understanding is a cognition through conceptions- not intuitive, but discursive and the understanding cannot make any other use of these conceptions than to judge by means of them and all the functions of the understanding therefore can be discovered, when we can completely exhibit the functions of unity in judgements.

Ziniewicz, G.L., 1996 elaborated that sensibility by itself is not knowledge; knowledge requires a further processing of the material of sensation; for Kant, knowledge means science; science is the interpretation of experience according to categories or rules. The laws of physics are the result of judgments based on experience and what categorizes or classifies or "objectifies" the data of perception is the understanding. Kant? claimed that the understanding judges or "categorizes" what is perceived according to twelve basic concepts or "rules."; these concepts are not "things in themselves" any more than space and time are things in themselves; they are forms for organizing experience; and these concepts or categories are meant to be applied to objects of experience. Noted from Kant, Ziniewicz then explained that we do not merely experience objects as next to one another and before and after, but we experience objects as acting upon one another in cause and effect relation- ships; while scientific judgment interprets what is experienced out there and what is experienced in here as belonging to an unbroken chain of causes and effects.

Further, Ziniewicz, G.L., 1996, clarified that the understanding orders experience under the category of causality; however, "cause" is not a thing in itself; it is an organizing principle. Therefore, the subject who examines objects of nature finds that they conform to laws of nature that they act predictably or causally upon one another. Moreover, based on Kant, Ziniewics elaborated that the subject who examines his own inner psychological states discovers the same sort of cause and effect relation; one's psychological life, as interpreted by understanding, appears to be completely determined by pre-existing conditions. Accordingly, we find causality in experience because understanding puts it there; cause and effect are the way we understand and interpret their relation to one another. Further he emphasized that for knowledge requires that theories be verified by sensible experience, knowledge is always tied to perception and it combines both understanding and sensibility. Furthermore, an object of knowledge is always at the same time an object that can be tied to a sensible intuition that is a perception of what is sensed. Ziniewics noted Kant that all seeing is sensible; the mind does not see apart from the senses; it only makes sense of, categorizes, and interprets what is given through the senses; the mere putting together of concepts is idle speculation or mere thinking.

Ziniewicz, G.L., 1996 concerned that just as sensibility reveals the polarity of perceiver and perceived, so judgment or knowledge reveals the polarity of subject and object in which human beings as things in themselves are not simply thinking things; the subject is but one polarity of the interpretation structure of knowledge; in that sense, it is part of the interpretation. Further, Ziniewicz noted Kant that reason attempts to unify all objects of knowledge and judgments of experience under general principles or simple ideas; it aims at complete knowledge; it runs far ahead of understanding working slowly with sensible intuitions; it anticipates perfect knowledge and envisions a coherent and orderly whole. Accordingly, the purpose of reason is to assist understanding and perception, by giving them unity such as projecting and anticipating ideal conditions; however, reason can know nothing by itself; it merely brings unity to experience.
